FDA and FTC Target Illegal Delta-8 THC Copycat Foods

On July 16, 2024, the U.S. Food and Drug Administration (FDA) and the Federal Trade Commission (FTC)
issued warning letters to five companies for illegally selling copycat food products containing delta-8
THC, in violation of the Federal Food, Drug, and Cosmetic Act. These products are especially concerning
because their packaging closely mimics popular snacks, increasing the risk of ingestion by children.
Moreover, these products often contain impurities or discrepancies in their composition, potentially
leading to unpredictable and harmful effects on consumers. These warnings are part of a joint effort by
the FDA and FTC to crack down on illegal delta-8 THC copycat foods.
